AUSTIN — AUSTIN -- A 32-year-old Austin man is accused of throwing his 2-year-old child out of a third-story window, according to an affidavit obtained by KVUE.

Police said that on March 27, a resident called police to report that her neighbor threw a toddler out of a window at an apartment complex located off of Anderson Lane. When police arrived, they spoke to the witness, who said that she was sitting outside when she heard yelling before she saw a man remove a third-floor window screen. She then said she saw him throw a toddler from the window. A woman -- later identified by police as the mother -- then ran downstairs, picked the child up and ran to the parking lot, the witness said.

The witness said the toddler landed on landscape rock, narrowly missing the sidewalk and the air conditioner unit. Police said they found blood on the landscape rock, which is located about 20 feet from the window.

Another witness said he heard some commotion and saw the man come down to get his child.

"I see something abnormal, after that I see police and after that I understand this [child] fell down," said Elshikh Essa, the witness.

Officers said no one was found at the apartment where the toddler was thrown from. Some time later, police said a man identified as Fnu Faizullah drove into the parking lot with two children in his car. Police said he wasn't wearing shoes, had a scrape on his arm and his pinky toe was bleeding. He told officers he had just returned from the hospital because his child had fallen. When officers asked him what happened, he said he was sleeping when one of his children opened a window. He then said the child fell out of the window, and Faizullah tried to catch the toddler, causing the scrape on his arm.

Police went to Dell Children's Medical Center, where hospital staff told officers that the toddler didn't have any broken bones, but did have multiple scrapes, bruising and lacerations caused by the fall.

When police spoke with Faizullah's wife, she told officers that the child fell at the park.

Faizullah faces a charge of injury to a child, a third degree felony. Austin police and Child Protective Services are investigating.
