Massive Silicon Valley food bank held up by appeal - San José Spotlight

Second Harvest of Silicon Valley could be close to breaking ground on its new headquarters in Alviso, but the nonprofit food bank must clear one more hurdle.

Plans for the massive, 250,000 square-foot warehouse—which will serve as a food handling facility with 31 loading docks, operations offices and a volunteer center—received approval from San Jose’s planning division assistant director in late May. Then one Alviso resident, Marcos Espinoza, filed an appeal opposing the project on the grounds it needs further environmental review. The San Jose City Council will decide Tuesday whether to grant Espinoza’s appeal, or deny it and let the project move ahead.

If allowed to proceed, the project could be complete by 2024, according to Diane Hayward, spokesperson for Second Harvest. The local food bank bought the roughly 10.4-acre site at 4553 and 4653 N. First St. in April for $37.2 million from South Bay Development Company, she said.

The site was previously envisioned as part of a larger 152-acre Cisco Systems development. Those plans included up to 2.3 million square feet of office, manufacturing and research and development space. The city previously evaluated the environmental impacts for the Cisco development in 2000 and approved them. Since then, a total of 1.8 million square feet of offices, warehouses and a hotel have been constructed on the 152-acre parcel, according to city reports.

Second Harvest’s plans wouldn’t create any new or significant impacts that haven’t already been considered and approved, city reports said, so the project should be clear to move forward under the California Environmental Quality Act (CEQA).

Mark Espinoza, who filed the appeal on behalf of his son Marcos Espinoza, says the project will generate nearly 900 daily vehicle trips, including 100 “heavy diesel truck trips and 45 trucks with diesel-burning top-mounted refrigeration units,” according to city reports.

Mark Espinoza said frequent truck runs and the 24-hour operation cycle of the headquarters could increase cancer risk and create distracting noise for children attending George Mayne Elementary School, which is located across the street.

The city’s health risk analysis showed the project would not exceed any of the significant cancer risk thresholds set by the Bay Area Air Quality Management District for the school or the Balaji Temple across the street. The city also noted in staff reports the food bank center would create less vehicle trips than the prior Cisco plans.

Mark Espinoza said the project should be halted while a new environmental impact report is completed, and that he is prepared to sue the city and Second Harvest if the appeal is denied. He has previously sued San Jose and a developer in an attempt to halt the Topgolf facility in Alviso from being built, but later settled out of court. He also recently appealed the city’s environmental review of a 214-room hotel in Alviso, also on North First Street, but the council denied his appeal on Aug. 11.

Espinoza said he is preparing to sue the city and developer for that project, as well.

“I hope that they go away. I hope that they find another location in San Jose,” Espinoza told San José Spotlight.

He said organizations build in Alviso because the community is largely working class and can’t easily fight the developments.

“This is another slap in the face to poor Hispanic people. The city is saying, ‘You have no value. Your life has no value.’ It generates money for the city, but they will never put that into Alviso,” he said.

District 4 Councilmember David Cohen, who represents the area, declined to comment due to the pending appeal decision.

Second Harvest officials are standing by plans for the food bank’s new headquarters.

“The CEQA documentation and determination are thorough, exhaustive, and complete,” CEO Leslie Bacho said. “Our new home enables us to continue our 30-year partnership with the Alviso community and feed 450,000 people in the region every month who are struggling with food insecurity.”

The judge should deny the appeal. This is weaponization of environmental review. Espinoza is abusing the judicial system and his repeated interventions add to increased development costs and overall cost of living in the Bay Area.

Very sad and surreal to read someone writing about how building a food bank is a “slap in the face to poor Hispanic people.”

The Espinozas sued Topgolf when they built in Alviso and made a lot of $$$ from an out-of-court settlement, he is trying to do the same thing here. They are trying to do the same thing here, to rip off a charity with a lawsuit, which will indirectly take food out of the mouths of their community. They are in it for themselves.

I recommend everyone do their due diligence before making such outrageous accusations without any proof. Any or all money from any settlement has been used and given to the Alviso community non profits to benefit Alviso. Also look at the facts of this development. I don’t see any of these type of facilities in wealthy community’s such as In Willow Glen.

Second Harvest has a warehouse in Willow Glen that has been operating for decades. I used to take lemons from my backyard there. There is a special place in hell for someone who would sue a food bank for such a petty and self-centered reason.

Please consider the major size difference of the warehouses, scale of operations, amount of truck traffic, and location of the facility in Willow Glen compared to the proposed development in Alviso. Below is the city website with the documents related to this development.

As a resident of Alviso, we have been shoved to the side since 1968 when we were annexed in to San Jose. We have 4 dumps, the poop factory, plus a peaker plant. San Jose has done hardly anything since then. They just improved 1st street in Alviso and within 6 months weeds appeared.. I had to beg San Jose to pick the weeds in the median. That was 6 months ago and the weeds are back. Gold street is always a weedy disaster. We did get Alviso a historical area but the weeds need to be pulled. The Alviso park still isnt what they promised 20 years ago. We already have 800 hotel rooms. Do we really need more in Alviso? No More deisel trucks no thanks. I call this environmental injustice which is very typical of government to move the crap in to the poor area of town. Good for him to sue! I’m on his side. Leave us alone!

“To the side” is a clue to something that hasn’t been made an open concern to any real extent so far.

Where are most expected food bank users going to be?

Reading some of these comments makes me sad. I applaud mr.Espinoza for standing up & taking action. As someone who lives in alviso, I am 100% behind him. Let’s not stay quite and let’s make some change!

Let’s speak facts: In San Jose – The Second Harvest of Silicon Valley paid their CEO Kathryn Jackson ($289,140). The organization had $126 million in revenues with 78.6% spent on relief programs. Hmm makes you wonder who is really out for themselves! If you’re not from Alviso then shut your mouth. This isn’t affecting you Willow Glen. Let’s put it across the street from your kids.

Interesting…maybe Mr. Espinoza’s fight would be taken more seriously if he didn’t mention just the Hispanics being harmed or inconvenienced by this new building. The service of this food bank will provide help to many cities throughout Silicon Valley. Me and my children would volunteer for the Second Harvest Food Bank of Silicon Valley…they hand out a great amount of groceries in the parking lot at Evergreen Valley College…and most of the clientele were of Asian decent and there was also plenty of Hispanic families waiting in line for their groceries too. The Second Harvest Food Bank helps many of the needy in Silicon Valley regardless of the ethnicity. I do understand Mr. Espinoza’s regard for his Hispanic community because I am down for my own people too, but there are more than just Hispanics that live in Alviso…right?.

It’s hard to believe a guy who says expanding the food bank is a slap in the face to poor people.

Food bank is a waste of time and resources. National chain grocers contribute too much waste by taking advantage of quantity discounts and stocking more product than they can sell before expiration. Money should instead be spent on SNAP benefit programs and grocers should hold flash sales when they need to offload products.

How is the food bank a waste? Then you immediately say the national chains are the waste? Makes no sense, just give people food.

I’m surprised the more “zealous” climate movement Faithful and worse typically don’t object to so much new development if favored politicians are promoting it, or if it’s for another lefty cause like housing — sea level rise and development in Alviso, we don’t consider no stinkin’ sea level rise and development in Alviso. This is exactly what is happening RIGHT NOW ON ALUM ROCK AVENUE.

The Community has been asking and asking the City for help in finding out what projects are planned on Alum Rock Avenue.

Most recently, you will see a portion of the SiliconSage Site that is under Construction.

The weeks, months, and years before – Plata Arroyo has been seeking information on the many Developers Sites because of the Pollution in the Ground from previous businesses.

The City is allowing Polluted Soil to be stored in the East Valley Community of Alum Rock Avenue.

The Polluted Soil has been there staged for two weeks now.

The City Council, The Mayor, and the Planning and Code Enforcement Department have informed and updated about this Pollution issue.

Plata Arroyo has even had o. Site meetings with other Council Members in the East Valley – but they are “quiet as a Door Mouse” at this time.

In the project that used to be the ‘Old Deseil Fuel Station’ across from Catholic Charities Senior Center, the Dirt is in Piles next to Alum Rock Avenue.

Here is a short list of locations that are going to be Negatively Impacted by Polluted Soil and Dust Particulates flowing into the Community.

Including but not limited to – • Regional Hospital • Senior Housing • Las Mariposas Housing Development • Senior Center (from above) • Senior Nutrition Centers • Mayfair Park • Mayfair Neighborhood Community Center • Plata Arroyo Park • Existing Homes and Apartments • Grail Childcare • Schools (Including Charter Schools) • Day Care, Licenced and Unlicensed • Baby Sitters, Licenced and Unlicensed

The City is not in the Business of protecting Our Health over Development Wealth.

Mr. Espinoza wins the argument but without his arguments. It has been pointed out that Alviso is low lying. 13 feet below sea level! This would make a large structure too expensive and risky to build. The great leaning tower of San Francisco is where this was tried with extensive piling. Joe Montana an investor is out of luck. Also with this in mind and ever increasing interest rates the project is dead on arrival. George Drysdale land economist and initiator of the San Jose Property Rights Initiative
